About Employment matters in Los Angeles

Employment law on the employee side covers wage and hour claims, wrongful termination, discrimination, harassment and retaliation. California gives employees more protection than federal law does in most of these categories, which is why a claim that looks weak under federal rules can still be viable here.

Wage and hour is the largest single category and the most mechanical: unpaid overtime, missed meal and rest periods, unreimbursed business expenses, and final pay that arrives late. These turn on records and arithmetic more than on intent, and they often have remedies attached that are larger than the underlying amount — a missed break is compensated by an hour of pay, not by the length of the break.

Retaliation claims are frequently stronger than the underlying complaint they follow. It can be unlawful to punish someone for raising a concern even where the original concern turns out to be mistaken, so the sequence of events after you complained often matters more than the complaint itself.

There are two practical points to establish in a first call. Ask which side the firm represents — many Los Angeles employment firms act for employees only, and a few act for employers. And ask about deadlines early: the administrative filing steps that come before a lawsuit have their own time limits, separate from the limitation period for the claim.

Common questions

General information about how these matters usually work in California and Los Angeles County. It is not legal advice about your situation.

Can I be fired without a reason?
California employment is presumed at-will, so an employer generally does not need a reason. What is unlawful is an unlawful reason — discrimination on a protected characteristic, or retaliation for protected activity. The question is therefore not whether a reason was given but whether the real reason was one the law prohibits.
What is the remedy for a missed meal or rest break?
One additional hour of pay at your regular rate for the day, and meal and rest premiums are separate obligations, so both can be owed for the same day. People routinely calculate their own claim at a fraction of its actual size by assuming the remedy matches the length of the break.
Do I have to complain to my employer first?
Not always, but the sequence matters. Raising a concern internally can convert a later adverse action into a retaliation claim, which is often stronger. Separately, some claims require an administrative filing before a lawsuit can be brought, and that step has its own deadline.
Do employment lawyers charge upfront?
Many Los Angeles employee-side firms take wage and discrimination cases on contingency, and several statutes shift fees to the employer if the employee prevails, which is what makes that model workable. Confirm the arrangement and how costs are handled at the consultation.
