About Workers' Compensation matters in Los Angeles

Workers' compensation is a separate system from personal injury, with its own courts, its own deadlines and its own vocabulary. It is a no-fault scheme: you generally do not have to prove your employer did anything wrong, and in exchange you generally cannot sue the employer in civil court for the injury. What it provides is medical treatment, temporary disability payments while you cannot work, and a permanent disability rating if the injury leaves lasting effects.

Because it is no-fault, the disputes are rarely about how the injury happened. They are about whether the injury is work-related, what medical treatment is authorised, and what the permanent disability rating should be. Treatment disputes in particular run through a utilisation review and independent medical review process that has strict timelines of its own.

Reporting is the step that decides most claims. Notify the employer promptly and in writing, get the claim form, and make sure the injury is described accurately from the outset — including cumulative injuries that developed over time rather than in a single incident. Later attempts to correct an initial description are routinely used to challenge a claim.

Some injuries generate a second claim outside the system: where a third party such as a driver, a contractor or an equipment manufacturer contributed, a separate civil case can run alongside the workers' compensation claim. Attorney fees in workers' compensation are set and approved by the appeals board rather than negotiated, so the fee is not where firms differ.

Common questions

General information about how these matters usually work in California and Los Angeles County. It is not legal advice about your situation.

Is workers' compensation the same as suing my employer?
No. It is a no-fault system that replaces most civil claims against the employer for a workplace injury. You generally do not prove fault, and you generally cannot sue the employer for that injury in civil court. A separate civil claim can exist where a third party contributed.
Can I be fired for filing a claim?
Retaliating against an employee for filing a workers' compensation claim is unlawful in California, and that is a separate claim from the compensation case itself, often handled by employment counsel. If it happens, the sequence and the documentation are what matter.
My treatment was denied. Is that the end of it?
No. Treatment denials go through utilisation review and can be challenged through independent medical review, but the process has strict deadlines that are easy to miss. Note the date on any denial you receive and act from that date.
What if my injury developed gradually rather than in an accident?
Cumulative trauma injuries are covered. They are harder to document precisely because there is no single incident, which makes the reporting stage and a consistent medical history more important rather than less.
