About Personal Injury matters in Los Angeles

Personal injury covers claims where someone else's carelessness caused you physical harm — traffic collisions, falls on badly maintained property, dog bites, defective products. The legal question is rarely whether you were hurt. It is whether the other side owed you a duty of care, whether they fell short of it, and whether that failure is what caused the specific injury you are claiming.

California runs on comparative fault, which means a claim is not defeated because you were partly responsible. Your share of the blame reduces what you recover rather than eliminating it. That is why insurers invest so much effort in establishing that you contributed — a percentage argued in the first weeks can be worth more than anything argued later.

Deadlines are the single most common way a good claim dies. Most California personal injury claims run on a two-year limitation period from the date of injury, but claims against a city, county or other public entity require a formal claim to be presented far sooner than that. If a government vehicle, a public road or a public building is involved, treat the timetable as urgent rather than ordinary.

Almost all Los Angeles personal injury firms work on contingency, so the consultation itself costs nothing. What varies between firms is the percentage, whether it rises if the case is filed or goes to trial, and how case costs — experts, records, filing fees — are handled if the claim does not succeed. Those terms are in the retainer, and they are worth reading before you sign.

Common questions

General information about how these matters usually work in California and Los Angeles County. It is not legal advice about your situation.

How long do I have to bring a personal injury claim in California?
The general limitation period is two years from the date of injury, with important exceptions — claims against public entities must be presented much earlier through a government claim process, and different periods apply to some medical and minor-related claims. Because the exceptions are where cases are lost, treat the date of the incident as a hard clock and get the deadline confirmed early.
Does it hurt my claim if I was partly at fault?
Not fatally. California uses pure comparative fault, so being partly responsible reduces your recovery in proportion rather than barring it. What matters is that the percentage assigned to you is argued on evidence rather than conceded early in a recorded call with an adjuster.
Should I talk to the other driver's insurance company?
You have no obligation to give a recorded statement to the other side's insurer, and early statements are routinely used to fix a fault percentage or to characterise an injury before it has been fully diagnosed. Reporting to your own insurer is a separate obligation under your own policy.
What does a contingency fee actually cover?
The percentage covers the firm's legal fee. Case costs — filing fees, records, expert witnesses, deposition transcripts — are usually separate, and how they are treated if the case is lost differs between firms. Ask for that in writing at the consultation rather than after.
