About Intellectual Property matters in Los Angeles

Intellectual property covers trade marks, copyright, trade secrets, licensing and infringement disputes, and — through a separately licensed bar — patents. In Los Angeles the client mix leans toward entertainment, apparel, consumer brands and technology, and the practical questions are usually about registering something, licensing it, or stopping someone else from using it.

Registration work and litigation are different practices with different skills, and a firm that files trade marks efficiently is not automatically who you want in an infringement suit. Ask which of the two a firm does most of. It is a fair question and a well-run practice will answer it directly.

Patent prosecution is a formal distinction rather than a preference. Only attorneys and agents admitted to practise before the USPTO may prosecute patent applications, which is a separate registration from a California Bar licence. Trade mark and copyright work does not carry that requirement.

Two things are worth knowing before a first meeting. Rights do not all arise the same way: copyright exists on creation and trade mark rights build through use, while registration adds enforcement advantages rather than creating the right from nothing. And trade secret protection depends on you having actually treated the information as secret — the protective measures you took beforehand are usually what the case turns on.

Common questions

General information about how these matters usually work in California and Los Angeles County. It is not legal advice about your situation.

Do I need to register a trade mark to have any rights?
No. In the United States trade mark rights arise from use in commerce, and unregistered marks have some protection. Registration adds significant enforcement advantages, including a nationwide presumption of ownership, which is why most businesses that intend to grow register anyway.
What is the difference between a trade mark, a copyright and a patent?
A trade mark protects what identifies the source of goods or services — a name, a logo. Copyright protects an original creative work as expressed. A patent protects an invention. Many products involve all three at once, which is why the first job is often sorting out which right is actually in play.
Someone is using my brand name. What can I do?
The realistic options range from a demand letter through platform takedown procedures to litigation, and which is appropriate depends on your rights, their use, and whether confusion is likely. Documenting your own first use and the other party's use is the groundwork for all of them.
Can any attorney file a patent application for me?
No. Only attorneys and agents registered to practise before the USPTO may prosecute patent applications, which is a separate credential from a California Bar licence. Trade mark and copyright filings do not have that restriction.
